Terms of Service
These Terms of Service ("Terms") govern access to and use of AssetHours ("AssetHours," "we," "us"), a software service for tracking equipment hours, maintenance attention, and service history, available at https://www.assethours.com and through related web and native clients. By creating an account or using AssetHours, you agree to these Terms.
Service description
AssetHours helps organizations record equipment information, meter readings, maintenance requirements, service events, issues, attachments, and related operational history. AssetHours provides reference equipment catalogs, manufacturer documentation links, and maintenance composition tools to assist your team. The service is informational and operational support software only.
AssetHours does not guarantee equipment safety, regulatory compliance, manufacturer compliance, fitness for a particular purpose, or that maintenance schedules in the product replace official OEM documentation, service manuals, bulletins, or mandated inspections. You remain solely responsible for safe equipment operation and for following applicable laws, regulations, and manufacturer requirements.
Accounts and organizations
You must provide accurate account information and keep your credentials secure. You are responsible for activity under your account. An organization owner controls billing, membership, and organization deletion. Authorized members act on behalf of the organization when they create or modify organization data.
You must ensure that people you invite or authorize to use your organization have permission to access the data they will see and submit.
Acceptable use
You agree not to:
- Use AssetHours in violation of applicable law.
- Attempt to access another organization's data without authorization.
- Probe, scan, or test the vulnerability of the service except with our prior written permission.
- Interfere with or disrupt the service, including by abusing APIs, cron-protected routes, or authentication mechanisms.
- Upload malware or content you do not have the right to store or share.
- Misrepresent your identity or affiliation.
Customer data and responsibilities
You retain ownership of the information your organization submits to AssetHours. You grant AssetHours the limited rights necessary to host, process, display, back up operationally, and transmit that information to provide the service and as described in our Privacy Policy.
You are responsible for the accuracy, legality, and appropriateness of data you and your authorized users submit, including maintenance records, issue descriptions, attachments, and policy choices. AssetHours may remove or restrict access to material that violates these Terms or creates risk to the service or others.
Reference, manufacturer, and OEM information
AssetHours may display reference equipment identities, suggested maintenance intervals, and links to manufacturer or third-party documentation sources. Reference data and documentation links are provided for convenience. Provenance, completeness, and timeliness vary by source. AssetHours does not warrant that reference schedules, documentation links, or composed maintenance states match current OEM requirements for your specific equipment, jurisdiction, or use case.
Subscriptions, trials, and billing
AssetHours offers organization-level subscriptions processed through Stripe-hosted checkout and billing portal pages. Current V1 commercial tiers include Starter Crew, Crew Pro, and Fleet Commercial, each available on monthly or annual billing intervals with server-enforced equipment capacity limits. New organizations receive a 14-calendar-day trial with Crew Pro equipment entitlement; a credit card is not required to start the trial.
When a trial ends without an active paid subscription, the organization enters a restricted unpaid state: data is retained, operational writes are blocked, and owner billing, authentication, and account-management paths remain available until a subscription is established. There is no automatic conversion to a paid plan and no permanent free tier.
If a paid subscription enters a past-due state, AssetHours provides a grace period (currently seven UTC calendar days) before applying the same restricted unpaid behavior. Downgrading a plan or exceeding entitlements does not delete your historical data; capacity limits are enforced at creation time for new equipment.
Fees, taxes, and payment terms are presented during Stripe checkout or in the billing portal. You authorize Stripe to charge your selected payment method according to the plan you choose. Subscription changes and cancellations take effect according to the billing interval and Stripe portal behavior; access to paid features generally continues through the end of the current paid period unless otherwise stated at cancellation.
Service availability
We strive to keep AssetHours available but do not guarantee uninterrupted or error-free operation. Maintenance, infrastructure failures, and events outside our reasonable control may cause downtime. Features may change as the product evolves; we will not materially remove core V1 maintenance tracking without reasonable notice where practicable.
Intellectual property
AssetHours and its software, branding, reference catalogs, and documentation (excluding your organization's submitted content) are owned by AssetHours and its licensors. These Terms do not grant you any rights to our trademarks or proprietary materials except as needed to use the service.
Disclaimers and limitation of liability
ASIDE FROM ANY NON-WAIVABLE RIGHTS UNDER APPLICABLE LAW, ASSETHOURS IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ASSETHOURS AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, EQUIPMENT DAMAGE, BUSINESS INTERRUPTION, OR PERSONAL INJURY ARISING FROM USE OF OR RELIANCE ON THE SERVICE, INCLUDING MAINTENANCE REMINDERS, REFERENCE SCHEDULES, OR DOCUMENTATION LINKS. OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO ASSETHOURS FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).
Some jurisdictions do not allow certain disclaimers or limits; in those jurisdictions, our liability is limited to the fullest extent permitted by law.
Termination and account deletion
You may stop using AssetHours at any time. Organization owners may delete an organization; individual users may delete their own accounts subject to product rules (for example, last-owner constraints). We may suspend or terminate access if you materially breach these Terms or if required to protect the service or other users.
Deletion behavior follows the product's account and organization deletion flows described in our Privacy Policy, including Stripe subscription cancellation for deleted organizations and retention of certain historical records.
Changes to these Terms
We may modify these Terms from time to time. When we do, we will update the effective date above and publish the revised Terms at this URL. Material changes will be communicated through the product or by email where appropriate. Continued use after the effective date of revised Terms constitutes acceptance.
